SJRES207

1) On August 5, 2026, Sen. Pete Ricketts (R-NE) introduced SJRES207, a joint resolution of disapproval under the Congressional Review Act. The resolution targets an EPA rule granting California a Clean Air Act waiver for its Advanced Clean Car program and Zero Emission Vehicle (ZEV) amendments. The bill has 7 Republican cosponsors and has been referred to the Senate Committee on Environment and Public Works — early stage, no further action yet. 2) This bill carries no direct funding authorizations; it is a procedural CRA resolution that, if passed and signed into law, would nullify the EPA waiver and prevent California (and the 13+ states that adopt its standards) from enforcing stricter emission and ZEV requirements. The money trail is entirely regulatory: automakers face significant compliance costs to meet California's ZEV sales mandates (e.g., percentage of EV sales each year) and stricter tailpipe standards. Overturning the waiver eliminates those compliance obligations. 3) No related signals, procurements, or presidential actions were provided, so convergence analysis is not applicable. The bill stands as an isolated early-stage challenger to California's regulatory authority. 4) Structural winners: Legacy automakers like Ford ($F) and General Motors ($GM) would benefit from reduced regulatory pressure, allowing them to moderate EV investment timelines and preserve near-term profitability from high-margin ICE trucks and SUVs. Structural losers: Pure-play EV companies like Tesla ($TSLA) lose a key regulatory driver for EV adoption and a source of profit (regulatory credit sales). Oil and gas producers ($XOM, $CVX) would benefit from slower EV adoption sustaining gasoline demand, but the link is indirect and confidence lower. 5) Timeline: The bill must clear the Environment and Public Works committee (unlikely given Democratic majority in Senate and White House), pass the Senate (needs 51 votes; 7 Republican sponsors may not be enough), pass the House, and be signed by the President or overcome a veto. Given the Democratic administration's support for California's waiver, a veto is nearly certain. Thus, near-zero probability of enactment in the 119th Congress.
